Sean'Diddy Comb seeks false hearing on testimony of balcony incident

According to documents obtained by Fox News Digital, the attorney of Sean “Diddy” comb, “Diddy” comb, supported the motion to retrial with the prosecution of misconduct.

Didi's legal team argued in a letter filed in southern New York on June 7 that the prosecution intends to file false testimony with the court.

Jurors last week heard testimony from Cassie Ventura's friend Bryana “Bana” Bongolan, who claimed Diddy hung her from a balcony on the 17th floor in September 2016. After Bana did not remember details of the alleged incident, part of her testimony was questioned, including what drugs were happening to her at the time.

Didi’s team wrote: “When a perjury testimony leads to a criminal conviction and the prosecutor knows or should know about perjury, the conviction must be set aside’’ If there is any reasonable possibility that it may affect the jury’s verdict,” Didi’s team wrote.

“In addition, the prosecutor knows that the use of perjury testimony may violate the terms of due process, even if it only undermines the credibility of the witness.”

Didi's legal team wrote that Cassie and Banna each provided “obviously false” evidence of the allegations against the court of the balcony charges, and then “doubled up, using this false testimony to obtain a ruling that acknowledges unacceptable anecdotal evidence, all of which provided a false narrative to the jury.”

Diddy's lawyer, Nicole Westmoreland, showed off the Bana papers to refresh her memory. The defense attorney then asked Didi if she took the stage in New Jersey on September 25, 2016, and she said she didn't remember it. Westmoreland asked Diddy and Cassie if they were in New York on September 26, 2016, and Bana said she didn't know. There is a short sidebar.

Westmoreland asked again if she knew Didi and Cassi September 26, 2016 in New York. She said no. Westmoreland asked Barna if she knew about the signing of Macy's. Banna said no again.

“You agree that one person can't be in two places at the same time,” Westmoreland said. “Just as theoretically, yes… it's hard to answer that.”

Westmoreland continued to ask Barna about the injuries she suffered from the balcony incident and the photos taken.

“Mr. Combs didn't make you see the injuries you saw on your phone on September 26,” she told Bana.

She replied, “I can't agree with you.”

Westmoreland also asked Bana if she told the government she was on MDMA, GHB and cocaine. “I didn't say those words,” Barna said, claiming “a lot of drugs” and saying she didn't do that that night.

“The government knows or should have known that this testimony is forged, and Ms. Bongolan was unable to be injured on the balcony of Los Angeles in the early morning of September 26, and even the day before that.”

“It stressed that the use of perjury testimony about the balcony incident was just one example of the prosecution of misconduct during the trial.”

The defense previously requested fingerprints of the fingerprints to the Los Angeles Police Department based on issues related to the so-called fingerprints Kid Cudi (Scott Mescudi).

The six-time Grammy Award-nominated rapper testified Didi's alleged break into his home. Kid Cudi also said he believed there was a shameful music tycoon involved in a car fire that left his Porsche damaged and irreparable. According to Kid Cudi, the two incidents happened after Diddy discovered that he and Diddy had a relationship with his girlfriend Cassie again.

In a federal indictment on September 17 Didi was sued Conspiracy of extortion (RICO); sexual trafficking by force, fraud or coercion; and prostitution by means of transportation. If convicted, he faces at least 15 years in prison or maximum sentence.

He maintained his innocence throughout the trial, witnesses demonstrating alleged rape, sexual assault, severe physical abuse, forced labor and drug trafficking.

The trial is expected to end on July 4.
