Bathroom and body workers fired for refusing to use trans pronouns

A former bathroom and body factory manager in Leiden, Utah said she was fired after refusing to speak to trans employees through her preferred pronoun.

Jocelyn Boden filed a charge of discrimination last week with the Equal Employment Opportunity Commission after she was terminated by the company she worked for three and a half years in May.

Boden is a “devoted member of the Church of Jesus Christ of Latter-day Saints.” Boden said she addressed her biological female colleagues under her name, but because of her religious beliefs, she could not address her colleagues through male pronouns.

“Ultimately, team members complained about Ms. Boden’s decision to the HR department for religious motivation,” the application states. “This complaint led to an interrogation of Ms. Boden’s use of pronouns. Ms. Boden expressed her religious objection to the pronoun policy for bathroom and body engineering, including in a discussion with her district manager, just two days before the district manager terminated Ms. Boden’s work.”

The filing report said that after these complaints were filed, Boden was quickly fired without warning and violated the company's discipline policy.

According to the documents in the document, the company lifted Boden for violating its code of conduct, “any harmful behavior targeting an individual based on its gender is prohibited, including sexual orientation, gender identity, gender expression or transgender status.”

Her alleged dismissal notice states: “Jocelyn acknowledged this behavior and shared with multiple parties that she refused to use the correct pronoun. Because of this investigation and her admission fee, we are deciding to separate the pathways and end their employment immediately to take effect.”

The discrimination charges were filed by First Liberty, a Texas legal group that fights religious freedom cases.

The first freely asserted that bathing and body engineering violated Boden's religious rights in Chapter 7, which prohibits employment discrimination based on protected characteristics such as race and gender. It also claimed that the company “anti-discrimination laws against Utah” violated the anti-discrimination bill because it expressed religious beliefs to Boden, failed to give her religious residence, permanently having a “hostile working environment” and “erroneously” terminated her work.

“I believe that inconsistent understanding of gender is dishonest,” Boden said in a filing submitted to the EEOC. “My beliefs do not allow me to lie by confirming what I think is wrong. Therefore, I cannot refer to women who are female pronouns.”

First, Stephanie Taub, a senior consultant at liberty, told CBN News that most workplace discrimination requirements must be processed through the EEOC before they can be resolved in court.

The EEOC told FOX News Digital that the law prohibits comment on alleged allegations.

A Bath & Body Works spokesperson told Fox News Digital: “Bath & Body Works complies with all laws regarding employment practices. As an equal opportunity employer, we do not discriminate against the management of our employees on any protected status.”
