Biden-appointed federal judge orders Trump administrator to resettle 12K immigrants

A federal judge on Monday ordered the Trump administration to immediately resettle about 12,000 refugees to the United States under a court order, which partially blocked President Donald Trump's executive order aimed at halting refugee enrollment programs.

U.S. District Court Judge Jamal Whitehead was named for former President Joe Biden's 2023 appointment, but despite the Trump administration's hearing last week, the order said it would only require 160 refugees to join the country and could appeal any order that requires thousands of them.

“The court will not entertain the rewrite of the results-oriented judicial order of the government, which clearly shows what it says,” Whitehead wrote on Monday. “Of course, the government is free to seek further clarification from the Ninth Circuit. However, the government is not free to violate the statutory and constitutional laws, as well as the direct orders of this court and the Ninth Circuit – while seeking such clarification.”

Trump signed an executive order on his first day at work, suspending refugee resettlement and ordering the Department of Homeland Security to report in a timely manner whether resumption of resettlement is in the interests of the United States within 90 days

In February, Whitehead blocked Trump Administration's move to respond to lawsuits from refugee aid organizations to suspend refugee enrollment.

Whitehead said Trump's action at the time was to formulate the “effective and invalid Congress will” of the national refugee enrollment plan.

Whitehead ordered the Trump administration to resume handling cases of refugees protected by court orders within the next seven days.

The federal judge also told the government to take immediate measures to promote U.S. refugees who allow access to the United States, including medical and safety authorizations, have not yet expired.
