Canadian Hockey Sexual Assault Trial: Defense Continues Cross-examination

The defense continued to cross-examine the complainant at Tuesday's hockey sexual assault trial and asked her about her incidents in London, Ontario, bars and hotel rooms.

This ongoing cross-examination is part of a trial, which saw five former members of Canada's 2018 World Youth Champions League team – former NHLERS MICHAEL MCLEOD, CARTER HART, ALEX FORMENTON, ALEX FORMENTON, DILLON DUBE and CAL FOOTE, each of whom was charged, did not plead guilty to one count of sexual assault. McLeod also pleaded not guilty to the additional sexual assault charges of the crime.

The allegations are related to the June 2018 incident, which was protected by the complainant EM under the publication ban, who claimed she had sexually assaulted in a hotel room after the Canadian hockey event.

David Humphrey, a McLeod defense attorney, asked the complainant about her knowledge of Jack's Bar players on the evening of June 18, 2018. He asked her about what she might have heard about McLeod’s Matt Maccarone man, who had been previously by another Royal Official’s London police detective Tiffany Waque teaced Tiffany Waque, who used to be “a team” but not a small team, but

“Do you remember Matt Maccarone said that Mr. McLeod was an elite player and might play in the NHL one day?” Humphrey asked.

“No. He said he was a good guy and took care of him. He made him look like he was living a good life, and he (McLeod) had a lot of money.” Em replied.

After cross-examination, Humphrey saw security footage from Jack's dance floor on the evening of June 18, specifically picking three specific frames that seemed to indicate that the complainant placed her hand on McLeod's crot's feet.

“They will move my hands to touch their crot foot area,” Em said in her crown testimony.

She agreed that in the video shown, she did touch McLeod's trouser rot herself, but she said there were other instances from the evening where some team members were moving her hands to their crotch area.

Humphrey further inquired about the video taken on the bar dance floor, which showed how much attention she seemed to have received from McLeod and other team members in the video.

“It's confusing me because I'm not used to this kind of attention at the bar. It's not common to me,” Em said. “They make it look good and I have to drink the amount I think I'll go with it. I think maybe I should be flattered and don't question too much.”

Humphrey questioned why they never just “ditched” McLeod in the bar, rather than going to the hotel with him in the early hours of June 19. The complainant, for example, said in her crown testimony that it has been difficult for her to say no to others.

“You said to all kinds of things you just don't want to do?” Humphrey asked.

“Sometimes, yes,” Em replied.

From there, the questioning shifted to Delta Armies Hotel, where both the complainant and McLeod followed the bar and then had voluntary sexual acts. Humphrey suggested that at that moment, em was the one who asked McLeod, even though the complainant said McLeod was the only one who thought of the idea and sent a message to other team members, whether he could invite his other friends to the room.

“No, I won't do that. I want to go home.”

Humphrey continued to inquire about the incident inside the hotel room, always questioning why she didn’t just leave the room or refuse any sexual demands from any man.

“You seem to have no choice,” Humphrey said.

“I have no choice, no,” Em replied.

Then, the focus of these questions was on a pair of videos taken in the hotel room at 3:25 am and 4:26 am on June 19.

Humphrey advised McLeod to ask if em the whole night was OK, but Em said she just recalled its appearance before shooting the video.

Humphrey asked about the end of the night after the last video and the “rude” behavior mentioned in the initial report that filmed the initial incident. The complainant testified that after the video, McLeod jumped onto the bed and said, “Did you leave soon?”

They said, “I don’t think the whole thing is respectful, but in the end, he’s rude.”

EM agreed with Humphrey on Monday when she had a boyfriend. Humphrey made this point again Tuesday.

“You're frustrated because you went to the hotel room alone and cheated on your boyfriend,” Humphrey said.

Em replied that she was angry about it and first went to the room.

Other members of the defense attorney are expected to continue further cross-examination of the complainant on Wednesday.
