NC Auto Accidents and Insurance Policy Limitations

If you are injured in a North Carolina car accident, you may be trying to get the party at fault or your insurance policy restrictions. This article discusses ways to get insurance policy restrictions from an insurance company.
In North Carolina, slogan drivers should pay for your medical expenses, lost wages, and pain and pain. In personal injury claims, insurance policy restrictions for dialing drivers should be determined as soon as possible.
Why are insurance policy restrictions important in NC car accident injury cases?
After being injured in a car accident, you may have high medical expenses, loss of wages, and pain and pain. Payment payments and how much your injury will pay for you.
If the other party hurts you and they do not have car insurance, you must use uninsured driver (UM) coverage.
If the party does not fulfill it, there is no Enough Coverage coverage (you can follow your policy), you may require underdriving driver coverage (UIM).
North Carolina Motor Vehicle Law requires continuous maintenance of automotive liability coverage.
As of July 1, 2025, “For all new policies or updated policies on or after that date, the minimum limit for personal injury will be increased to $50,000 per person, $100,000 per person accident, and the minimum limit for property damage will be increased to $50,000 to $50,000,” (NC Insurance Department).
Please note that until the policy renewal of opposition parties after July 1, 2025, it will still have a minimum minimum requirement before July 2025, at $30,000/$60,000/$60,000/$25,000.00 (NC DOT).
Unfortunately, even if North Carolina’s minimum insurance increases, it may not be enough to cover all losses if your losses exceed the limit.
How to find out someone’s insurance policy limit?
Obtaining policy restrictions from an ATFART party insurance company can be difficult. This is especially true when you are involved in a multi-vehicle accident or catastrophic accident, and someone is injured.
1. Ask your own insurance company
Sometimes, your own insurance company can tell you the restrictions on the dialer’s insurance policy. Insurance companies don't want to pay claims; if they can help you get money from another insurance company's policy, they will.
Ask your own insurance regulator if you know of policy restrictions that violate party insurance.
This step is not always effective, but it is worth a try.
2. According to NC General Regulations §58-3-33
If a party’s insurance is violated and unwilling to disclose policy restrictions, you can try to ask them to do so under Section 58-3-33.
58-3-33 Need:
- The injured victim or person who causes property damage under the policy must send the following to the insurance company via certified mail:
- Policy-limited written requests and
- Consent to the written consent of all medical providers to release the person’s medical records three years before the date of the accident, and all medical records related to the requested injury and related to
- Written consent to mediate with the insurance company and
- Submit a copy of the accident report (police report), as well as a description of the incident, which allows the insurer to make a preliminary determination of the potential liability of the insured
The insurance company must provide insurance restrictions within 30 days of receipt of the above documents.
A mediation agreement is not a problem, but it is not always recommended to access your medical records.
Even if your medical records indicate that you have not had any harm, your personal health information does not involve your harm and should be reviewed before handing it to the insurance company.
Unfortunately, a bad insurance regulator (we've actually heard of it) can try to argue that your diabetes makes them insured bone bones.
3. Document litigation
Another way to determine insurance policy restrictions is to file a lawsuit. Unfortunately, some insurers will not provide policy restrictions information until a lawsuit is filed and a formal discovery is requested.
In addition to policy restrictions known for coverage, asking about umbrella policies or additional insurance found can also help open the door to additional compensation.
Litigation seems like a daunting step to figure out this information, but if the insurer doesn't tell you the policy limits, there are certainly other issues to file a lawsuit.
